Finnish Rural Tourism Entrepreneurs (Suomen Maaseutumatkailuyrittäjät ry)
c/o MTK ry, P.O. Box 510, 00101 HELSINKI
These standard terms apply to a contract concerning a Rural Travel Service when a Rural Tourism Entrepreneur offers rural tourism services to a private Customer or to a group of two or more Customers. This contract does not apply where combined travel services (package travel combinations) are offered.
In these standard terms, a rural tourism service means:
a) accommodation;
b) accommodation and another tourism service that is not essential to the whole;
c) one or more programme services such as; meals, banquet, party and meeting arrangements, arranging pastime and hobby opportunities such as fishing, skiing, hiking, riding, canoe and forest trips, as well as guidance, instruction and training related to the services, taking item b) into account; or
d) transport as part of a service package.
In these terms, a Rural Tourism Entrepreneur means a business that offers rural tourism services to consumers through a separate offer, an application (for example social media or a website) or otherwise.
In these terms, a Customer means a consumer customer.
The Consumer Protection Act, the Contracts Act and other legislation apply to a contract concerning a rural tourism service.
The Package Travel Act is applied only in situations where its application is mandatory under the law.
The contract is formed when the Rural Tourism Entrepreneur has made an offer and the Customer has accepted it unchanged.
These terms become binding on the parties and part of the contract when the terms have been sent to the Customer, or a link to the terms has been sent to the Customer, and they have been referred to in the offer before or at the time the contract is formed. The terms or the link to the terms are always deemed to have been delivered if they have been sent to the address, email, phone number or other means of communication given or used by the Customer.
The contract is also formed when the Customer has notified the Rural Tourism Entrepreneur of an order on the basis of their price list or offer, directly or through an application, and the Rural Tourism Entrepreneur confirms the order, or the application does the confirming. In this case too, these terms become binding on the parties when the terms have been available to the customer and have been referred to.
The Customer must identify themselves, in accordance with separately given instructions, through the application or otherwise when booking Rural Tourism Services. The Rural Tourism Entrepreneur complies at the very least with the data protection required by law.
The payment terms in this section apply if the Rural Tourism Entrepreneur and the Customer have not agreed otherwise.
At the time of booking the service, 50% (including any value-added tax) of the price of the service is paid, and the remaining 50% (including any value-added tax) of the total price of the service is paid 14 days before the agreed start date of the booking. If the booking is made less than 30 days before the start of the service, the Customer pays the full price of the service when booking it. Payments are not refunded, and collection of them is not waived, unless otherwise stated in the sections below.
If the booking is made by phone, the booking is confirmed to the Customer by electronic means, and these contract terms are provided at the same time, in which it is agreed how the Customer has the right to cancel their booking. If the Customer does not pay the invoice received by the due date, statutory late-payment interest is charged on the overdue amount, as well as collection costs.
If the Customer’s order is subject to the provisions of the Consumer Protection Act on distance selling, the Customer has 14 days in which to cancel the order. The Customer should check whether their travel insurance can provide compensation for costs arising from a possible cancellation. If the cancellation is due to an absolute prohibition by the authorities on travelling, the customer has the right to cancel. If it concerns a pandemic or similar, it does not in itself entitle to cancellation if it does not directly prevent the provision and use of the service, or if the information about the pandemic was available before the booking.
The obstacle must be reported to the Rural Tourism Entrepreneur without delay by email, text message or another reliable means. An illness, accident or other event that prevents use of the service does not entitle the Customer to cancel the service, and the Customer may seek compensation, for example, from their own insurance company.
Unless the Customer and the Rural Tourism Entrepreneur have agreed otherwise, or the Rural Tourism Entrepreneur has not notified otherwise, the Customer’s right to cancel a booking without a previously agreed reason is available as follows:
a) no later than three months before the start of the service, by paying the Rural Tourism Entrepreneur’s costs notified in advance, however at least 25% of the total price of the service;
b) later than 3 months but no later than 30 days before the start of the service, by paying 35% of the total price of the service;
c) later than one month but no later than 14 days before the start of the service, by paying 50% of the total price of the service; and
d) later than 14 days before the start of the service, by paying 100% of the total price of the service.
Notice of cancellation or of reducing the service must be given in writing or electronically or, if notice cannot be given in writing/electronically, by another reliable means to the address, contact or contact details given by the Rural Tourism Entrepreneur.
If the Customer does not use all of the agreed services or uses them only partly (for example reductions in the number of people), they are not on that basis entitled to a price reduction or a refund, unless they have been cancelled in accordance with the terms of this contract or it has been separately agreed otherwise between the Rural Tourism Entrepreneur and the Customer.
The Rural Tourism Entrepreneur has the right to terminate the contract or interrupt the performance of the service if force majeure, such as fire, a power outage, a natural disaster, an action by the authorities, a strike or another comparable unforeseeable event independent of the Rural Tourism Entrepreneur, prevents or substantially impedes the provision of the service. If the contract is terminated, the entire price paid must be refunded to the Customer, or if the performance of the service is interrupted, the price corresponding to the part not performed must be refunded within a reasonable time.
The Rural Tourism Entrepreneur must notify the Customer without delay of the obstacle due to which the service will not be provided.
The Rural Tourism Entrepreneur is responsible to the Customer, for themselves and also on behalf of their subcontractors, for ensuring that the Customer receives the services in accordance with the contract, as they are separately stated in each booking and confirmation.
The Customer is entitled to compensation only for direct damage caused to them by a fault in the Rural Tourism Entrepreneur’s performance, if the fault or damage is due to the intent or gross negligence of the Rural Tourism Entrepreneur, their employee or another business operator used as their assistant. The maximum amount of compensation is the sum paid for the Rural Tourism Service, unless there are special grounds for otherwise.
The Rural Tourism Entrepreneur is not liable for damage caused by force majeure or another unforeseeable cause that the Rural Tourism Entrepreneur, an employee or a business operator used as their assistant could not have prevented even by acting as carefully as possible. The Rural Tourism Entrepreneur must notify the customer of the obstacle without delay and endeavour to act so that the damage suffered by the customer is kept as small as possible.
The Customer must comply with the understandable instructions, warnings and regulations given by the Rural Tourism Entrepreneur relating to the use of the service, and use the safety equipment in accordance with the instructions. The Customer is liable for damage caused intentionally or through negligence by them or by a minor under their supervision, a guest of the Customer or an accompanying pet to the Rural Tourism Entrepreneur, their business or third parties.
The Customer is obliged to ensure that they have the valid documents required for use of the service, such as a passport, visa, driving licence, firearms permit and proof of payment of the fishery management fee. The entrepreneur is not responsible for voluntary insurance the customer needs for the trip, but the customer is themselves responsible for their insurance cover and its adequacy, e.g. with regard to cancellation cover.
The Customer is obliged, immediately upon noticing a fault or deficiency, to make a complaint to the entrepreneur or their representative about any deficiencies that can be remedied during use of the service. Any other complaints that could not have been remedied during use of the service, and any claims for compensation, must be made in writing to the entrepreneur within a reasonable time from when the fault was noticed or should have been noticed.
If the customer and the entrepreneur cannot reach an agreement, the customer may bring the dispute before the Consumer Disputes Board, and ultimately for a court to resolve.
